Since shortly after the COVID-19 crisis emerged, the Condominium Act was revised to permit condos to hold virtual AGMs and board meetings, and to facilitate electronic voting. Those emergency provisions are due to expire on September 30. Although it appears that the province may move to extend the deadline or make the changes permanent, it’s far from certain. Therefore, we encourage all corporations that have not already done so, to pass a by-law authorizing virtual meetings and electronic voting.
As the recent CondoAdvisor article suggests, corporations with AGMs on November or later, can wait and see what the province does. However, condo corporations with October AGMs should act now to put a by-law in place. Given the tight deadline corporations should call one of the E-Meeting companies ASAP to schedule the meeting. Once the meeting is booked, you will have to issue proper meeting notice.
REMEMBER: if you do pass an e-meeting/e-voting bylaw, ensure your corporation’s lawyer registers it on title immediately after your owners’ meeting.
