Amended Condo Act – Phase 1 – Links to the Act & Prescribed Forms

As of November 1st, many sections of the amended Condominium Act, 1998 and regulation O. Reg. 48/01 have become effective.

We have now come full circle.  We started with the Condominium Act, 1998 and regulation O. Reg. 48/01. After extensive consultation, the province approved the Protecting Condominium Owners Act, 2015 (PCOA) which amended the Condominium Act, 1998 and regulation O. Reg. 48/01 and created the Condominium Management Services Act (CMSA). Regulation O. Reg. 123/17 provided for details on licensing, 177/17 created the Condominium Management Regulatory Authority of Ontario (CMRAO), 178/17 provided regulation-making authority, 179/17 created the Condominium Authority Tribunal (CAT), 181/17 created the Condominium Authority of Ontario (CAO) and 180/17 addressed several changes to the core Condominium Act, 1998

The amendments have now been rolled into the original Act and regulation and we’re once again left with the Condominium Act, 1998 and regulation O. Reg. 48/01, albeit in substantially changed form.

The November 1st changes include new information certificates, a two-stage meeting notice process, a new process for making and responding to records requests, and licensing of condominium managers. The changes are extensively “form-driven.”  There are mandatory, prescribed forms for almost everything.  Here’s a list of links to the amended Condominium Act, 1998, the amended regulation O. Stay tuned for more changes as additional sections of the Act and regulations are proclaimed and become effective though out 2018.
